We’ve been keeping you informed about our federal lawsuit against Maura Healey, the Department of Public Health, and their cronies, who ran a million-dollar smear campaign against pro-life pregnancy resource centers (PRCs). Over the past year and a half, MLLC and ACLJ have been actively litigating this case, seeking to achieve justice for PRCs that were slandered and threatened just because they save lives instead of peddling abortions.
This week, we received the news that the court granted the defendants’ motion to dismiss, finding that we had not adequately alleged that the State violated the First Amendment rights of our client, Your Options Medical PRC. The judge held that DPH’s actions, including soliciting complaints against PRCs while letting abortion clinics off the hook, threatening to revoke the licenses of medical providers who engage in abortion pill reversal, and accusing all PRCs of illegal conduct, would not rise to the level of unconstitutional threats.
But we know that the State’s smear campaign was an illegal attack on pro-life centers and are committed to continuing the fight to vindicate their rights. We will appeal the district court’s decision and take this case as far as we can to achieve a just outcome for Your Options Medical and all other Massachusetts PRCs. Stay tuned for future updates.
